Property acquired by the illegeal

Q . The Assessee is not havg the legal right to acquired the property and the same property has given to the builders and the builder has given the new property as exchange of the property .
1) what will be the tax treatment ?
2) The Builder can acquired this property ?
3) or any other liability can arise . ?
