No, because MCA will deactivate the DIN of the Director who has failed to file DIR -3 KYC, meaning thereby the said Director will not be able to use his/her DIN for any purpose under Companies Act, 2013.

No. In that case he will not be able to act as director of any company as his DIN will be deactivated.
