A(GRANDFATHER) B(GRANDSON) A MADE A POWER OF ATTORNY IN THE NAME OF B. B SOLD CERTAIN PART OF THE LAND IN PLOTS I.E AFTER PLOTTING A DOESNOT HAVE PAN NO. IN ALL THE SALE DEED(BENAMAS) B's NAME is SHOWN AS HOLDER OF POWER OF ATTORNY ALONG WITH HIS PAN NO. NOW A IS NO MORE & HIS ONLY LEGAL HEIR IS B .THEN HOW SHOULD THIS BE REFELECTED IN ITR OF B ?

Income has to be assessed in the hands of 'A.' since 'A' is no more 'B' has to file the return of 'A' in the capacity of a representative assessee.

Power of attorney is not ainstrument of transfer in any right, title or interest in any immovable property. The power of attorney is a agency the grantor authorizes the grantee to acts specified therein, on behalf of grantor, which when executed will be binding on the grantor as if done and by him.
