A person having income less than 2.5 lacs files income tax return in January 23 for Fin Year 2021-22. He shall not have to pay late fees. Am I correct

You can not file it in January 2023 as the last date for filing belated return is 31-12-2022.

in january updated return can be filed only. you can not file updated return below 2.5 lacs. So eventually you have to pay penalty of 1000 to file the return.
