ITR for AY 2022-23

Hello all, As due date for filing ITR for AY 2022-23 was 31.12.2022, however one of my friend hasn't filed the ITR, he has huge TDS of around Rs. 2L on sale of property. What can be done now? Can we include such income as well as TDS in ITR of AY 2023-24? or condonation of delay can be filed? what can be done? Please suggest. Thank You.

Income and TDS of A.Y.2022-23 cannot be included in A.Y.2023-24. It should be shown in the assessment year to which it relates. Only remedy is to file return for A.Y.2022-23 after filing delay condone application.

You cannot include the Income and TDS of AY2022-23 in AY2023-24. You have option to file updated return under section 139 (8A) of the Income tax Act for AY 2022-23

What the reasons for not filing Return within Due Date? If reasons are genuine, you can apply for Condonaton of Delay and once it is approved you can file Return and claim Refund. If reasons are genuine, Deparment/Ofifcial will consider it favorably and will condone the delay.
