Demerger

My proprietorship firm was merged in to another firm in 2020 but now i want to practice with my own trade name but wants to continue as partner in that firm. what procedure i have to follow? we have also entered in to partnership at that time in 2020? will it continue? or to enter in to new partnership?

Since your proprietorship firm was merged into a partnership firm in 2020 and you became a partner through a valid partnership deed, that partnership continues unless dissolved or reconstituted. If you now wish to start practicing again under your own trade name as a proprietorship while continuing as a partner in the existing firm, you can do so independently—there's no need to exit or create a new partnership, unless the original deed restricts such dual activity. However, you may need to update professional registrations, GST, and inform the ICAI (if applicable) about your dual roles, ensuring there is no conflict of interest or breach of any professional code.
